CyberMark provides digital marketing services including, but not limited to, website design and development, search engine optimization, digital advertising management, local listing management, and reputation management. All content, features, and functionality on the CyberMark website and platforms — including text, graphics, logos, icons, images, and software — are the exclusive property of CyberMark or its content suppliers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws. Client-owned content remains the property of the client; however, CyberMark retains ownership of all proprietary tools, templates, and platform infrastructure used to deliver services.

Limitation of Liability and Governing Law

CyberMark shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to or use of (or inability to access or use) our services, including but not limited to loss of revenue, loss of profits, loss of business, or loss of data. Our total cumulative liability to you for any claims arising under these terms shall not exceed the total fees paid by you to CyberMark in the three months preceding the claim. These Terms and Conditions are governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict of law principles. Any disputes arising under these terms shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona.
